SC orders release of mining executive on P900K bond

The Supreme Court has ordered the Bureau of Immigration (BI) to release mining executive Joseph Cue Sy upon posting a P900,000 bond while litigation over his Philippine citizenship remains pending.
In a resolution dated 7 October 2026, the high court's First Division granted a writ of preliminary mandatory injunction directing immigration authorities to release Sy from detention, subject to compliance with the bond requirement.
The court also ordered BI officials to submit a written compliance report within 24 hours of his release.
The ruling provides Sy with temporary relief but does not resolve the underlying dispute over his citizenship.
Sy, an executive of Global Ferronickel Holdings Inc., was arrested at Ninoy Aquino International Airport Terminal 3 on 21 August 2025 over allegations that he falsely represented himself as a Filipino citizen.
Immigration authorities alleged that Sy was the same person as Chinese national Chen Zhong Zhen, raising questions about the authenticity of his Philippine citizenship documents.
In September 2025, a Taguig regional trial court granted a petition for habeas corpus seeking his release.
The Court of Appeals upheld that ruling in February 2026, giving greater evidentiary weight to Sy's birth certificate and Philippine passport.
Despite the favorable court decisions, Sy remained in immigration custody as government authorities pursued further legal challenges involving his citizenship and civil registry records.
In its latest resolution, the Supreme Court directed the BI personnel holding Sy to release him upon presentation of proof that the required bond had been posted.
The high court also consolidated the petition filed on Sy's behalf by Dante R. Bravo with a related petition filed by immigration officials.
The petitioner was given 10 days to respond to the government's submissions.
The proceedings will continue as the Supreme Court considers the competing claims concerning Sy's nationality and the legality of his detention.
