Makati Court favors FLGMDC in unlawful detainer
Makati City Metropolitan Trial Court Branch 63 Presiding Judge Alberto N. Azarcon III ruled in favor of FLG Management and Development Corporation (FLGMDC), a company owned by lawyer Felipe L. Gozon, in an unlawful detainer filed against One EMJJ Realty Builders and Supply Inc. and its president Engr. Oscar Nuñez.
The complaint stemmed from defendants One EMJJ Builders and Nuñez failing to pay any rental since occupying FLGMDC’s four-storey building on 30 October 2017.
FLGMDC earlier granted Nuñez’s multiple requests to extend and defer rental payment, but after the defendants still failed to pay, it decided to cancel their contract of lease and served final notice for the defendants to vacate the building and to pay their unpaid rentals from October 2017 to June 2018.
In his decision promulgated on 28 August 2019, Judge Azarcon wrote that the “plaintiff was able to establish its right to eject defendants from the property by preponderance of evidence,” and that the defendants may now be legally ejected from FLGMDC’s building in Makati City.
The Court issued a writ of execution requiring One EMJJ Builders and Nuñez to jointly and severally pay over P2 million as unpaid rentals from 5 October 2017 to 3 July 2018, the unpaid rentals of P250,000 per month from 4 July 2018 until the defendants vacate the leased premises, plus the attorney’s fees and cost of suit.
