Following the statements made by former Ako Bicol Partylist representative Elizaldy “Zaldy” Co’s lawyer, Atty. Ruy Rondain, that his client is afraid to return to the Philippines due to alleged threats to his life, Assistant Ombudsman Mico Clavano said such reasoning has “become a template” after the Independent Commission for Infrastructure (ICI) recommended graft, malversation, and falsification charges against the former lawmaker.
During a radio interview, Clavano said the Office of the Ombudsman will explore legal remedies to bring Co back to the country, including extradition and possible inclusion in an Interpol Red Notice, should the cases proceed and Co be deemed a fugitive.

Clavano stressed that Co’s case is not pre-judged, and that the Office of the Ombudsman is still evaluating evidence related to the alleged flood control scam. He noted that Co has yet to file his counter-affidavit.
He reiterated that Co’s right to present his defense will be waived if he fails to submit within the allowed period.
“We will have to resolve the case here with the Ombudsman on the basis only of the allegation and supporting documents. We cannot wait because there are periods for which we allow respondents to file counter-affidavit including his co-respondents,” he said.
Clavano further explained that if the Ombudsman finds probable cause and files a case before the Sandiganbayan, the anti-graft court will issue a warrant of arrest — a move that can trigger a Red Notice request through Interpol.
“The court must have jurisdiction over the person before proceeding to trial. The warrant of arrest will be used as an instrument to put Co’s jurisdiction under Sandiganbayan,” Clavano said.
