The Department of Justice (DOJ) has confirmed receiving a supplemental referral from the Philippine National Police–Criminal Investigation and Detection Group (PNP-CIDG), which recommends the filing of additional criminal charges against former Ateneo men’s basketball coach Tab Baldwin and several others in connection with the drowning deaths of two student-athletes.

“The DOJ confirms receipt of a supplemental referral from the CIDG in relation to the same matter,” Martinez said.
He said the CIDG is now recommending the filing of charges for homicide and/or reckless imprudence resulting in homicide, as may be supported by the evidence and applicable law.
Martinez added that the supplemental referral will not be treated as a separate case but will instead form part of the CIDG’s original referral submitted to the DOJ on 26 June.
“The supplemental referral will be treated as forming part of the CIDG’s original referral dated 26 June, which remains under evaluation by the Department,” he said.
The initial referral sought the filing of charges for alleged violations of Republic Act No. 11053, or the Anti-Hazing Act, against Baldwin and several other individuals over the deaths of Ateneo student-athletes Rene Baterbonia and Divine Adili during a team-building activity in Dipaculao, Aurora, on 8 June.
Earlier, the DOJ said the 26 June referral remains under evaluation to determine whether the evidence submitted by the CIDG is complete and sufficient for a preliminary investigation or whether further case build-up is necessary.
The department has yet to announce when it will complete its evaluation of the referrals.
