This disturbing tax evasion scheme has raised concerns among restaurant operators, who are legally responsible for shouldering the 20-percent discount mandated by the government.
On a larger scale, the nation is estimated to have lost P88.2 billion in tax revenues in 2023 alone, as revealed in a Senate probe. This comes at a time when establishments granted approximately P166 billion in discounts.
Shockingly, of the 8.5-million people who reportedly use PWD IDs, only 1.8 million were found to be “legitimate” beneficiaries. This massive disparity highlights the extent of the problem, which undermines the system and places a significant financial strain on businesses that comply with the law.
When restaurants lose money due to fraudulent discounts, it directly affects their ability to pay their employees, maintain the quality of the food, and keep menu prices affordable for honest customers.
As restaurant owners face mounting pressure to comply with tax requirements and face the threat of BIR audits, the cycle of financial strain only intensifies.
With more people emboldened to use fake IDs, what lies ahead for the restaurant industry, especially at a time when Filipino cuisine — like our iconic adobo, lechon, sisig and sinigang — is beginning to tantalize palates around the world and gain momentum on the global culinary map?
For one, the prestigious Michelin Guide recently set its sights on the Philippines, with recommendations for Manila and Cebu to be unveiled in its 2026 edition. In 2023, Iloilo City was named a Unesco City of Gastronomy, recognized for its outstanding food culture and culinary traditions, including specialties like La Paz Batchoy and Pancit Molo.
The Department of Tourism, citing Future Market Insights, reported that the Philippine gastronomy tourism market topped an estimated $5.4 billion in 2022, with projected annual growth of 14.7 percent over the next decade. However, with each fake PWD ID handed over to the cashier after every meal — especially when many fake PWDs are used at a single table — we risk a future where the Philippine gastronomic industry will suffer from leftover gains and a bland reputation.
Asian Consulting Group (ACG), through the wisdom of its founder and CEO Mon Abrea, has been urging the Bureau of Internal Revenue (BIR) to implement an automated system for verifying PWD and senior citizen discounts.
A digital platform could ensure that only qualified individuals benefit from the discounts. It would also make it easier for the BIR to authenticate names through the Department of Health and the National Council on Disability Affairs.
Pending these reforms, restaurants — especially those reporting significant PWD discounts — now face the risk of stricter BIR tax assessments and compliance checks. If discrepancies are found, businesses could be subject to tax reassessments, including for income tax and VAT deficiencies, along with penalties and interest, in order to recover the lost tax revenue.
