The Tacloban City Prosecutor’s Office has recommended filing charges against police officer Arla Ray Pacencia, the registered owner of the firearm used in the deadly incident at San Jose National High School, the Department of Justice (DOJ) said Tuesday.

DOJ spokesperson Polo Martinez said prosecutors on 20 August recommended charging Pacencia with reckless imprudence resulting in multiple homicide and physical injuries.

The corresponding information will be filed before the Family Court of the Tacloban City Regional Trial Court, Martinez said.

The recommendation stemmed from a preliminary investigation into a complaint filed by parents and students following the shooting involving children in conflict with the law.

Pacencia, an aunt of one of the alleged minor suspects, earlier told a Senate hearing that the minor, identified only as alias “Nash,” unlawfully entered her locked house and forcibly damaged a lock.

The minor allegedly obtained Pacencia’s firearm and used it in the school shooting.

Three teenagers were killed and 13 others were injured in the August shooting at San Jose National High School.

Police said two Grade 9 students, aged 14 and 15, allegedly opened fire inside the school.

Under Philippine law, a child in conflict with the law refers to a person below 18 accused of committing an offense.

The DOJ said the criminal case against Pacencia will proceed in accordance with due process.
