The Supreme Court ordered the Commission on Elections to comment on the petition filed by ousted Albay Governor Noel Rosal seeking to enjoin the poll body from implementing its resolution disqualifying him from his post.
The SC issued the order during Tuesday's regular en banc session of the 15-man High Tribunal.
The Comelec and private respondent Joseph San Juan Armogila was given 10 days to comment on Rosal's petition for certiorari and application for the issuance of a status quo ante order or temporary restraining order and/or writ of preliminary injunction.
Rosal, in his petition filed on 21 November 2022, asked the SC to issue a SQAO or a TRO to stop the enforcement of the Comelec's resolution issued on 18 November 2022.
