The Sandiganbayan Second Division has acquitted former Cebu port officials charged with violation of Section 65 of Republic Act 9184 or the Government Procurement Reform Act for delaying the opening of the bidding for janitorial services for the Cebu Port Authority (CPA) in 2011.
In its decision last 25 October, the Court ruled to dismiss the case filed against former Engineering Services Department Manager and Bids and Awards Committee Chairman Mario Tan, Port Management Department Manager and BAC Member Oscar Lopez, Finance and Administration Department Manager and BAC member Glenn Castillo, Administrative Division Manger and BAC Member Perlita Jumapao and Construction and Maintenance Division Manger and Provisional BAC Member Sofronio Magdadaro for failure of the prosecution to prove their guilt beyond reasonable doubt.
The Court ordered the release to each of the accused the amount of P30,000 which they deposited as bail for their provisional liberty.
