The mining firm was dragged into a graft case in 2016 when Agham Partylist accused then PPA General Manager Juan Sta. Ana and Assistant General Manager Raul T. Santos of granting DMCIMC, a private port owner and operator, automatic renewal of permit from 2013 to 2017 without the requisite foreshore lease agreement with the DENR.
The Office of the Ombudsman, however, announced in September its dismissal of the complaint in June due to insufficient evidence. The Ombudsman found that under PPA regulations, a renewable port permit can be granted through the payment of annual occupancy fee in lieu of the DENR-approved foreshore lease contract or provisionary foreshore lease permit.
PPA records showed that DMCIMC paid in 2011 its occupancy fee for 2012 to 2014 making the grant by Sta. Ana and Santos of a five-year renewable permit in order and therefore, did not violate the Anti-Graft and Corrupt Practices Act.
Likewise, the Ombudsman found that Sta. Ana and Santos promptly acted on the complainant’s request to investigate irregularities in the issuance of port permits based on the numerous letters sent by the PPA to Agham about the agency’s actions.
Sta. Ana resigned as PPA general manager in 2015. Santos replaced him but only until 2016 when the administration appointed Jay Daniel Santiago as the new head of the port regulatory agency.
