The Bureau of Immigration (BI) yesterday clarified that Australian professor Gill Hale Boehringer is not being detained and that he remains at the Ninoy Aquino International Airport Terminal 1.
BI spokeswoman Dana Krizia Sandoval explained that upon service of the exclusion order, the custody of the passenger is immediately turned over to the airline that took him into the country.
Under the law, the excluded passenger is required to board the next available flight back to his or her port of origin.
Sandoval stressed that Boehringer is staying in the airline’s exclusion room, which is provided with basic amenities for a comfortable stay, pending his return flight.
She said he may opt to file a petition for the lifting of his name in the blacklist, subject to the presentation of proof to reverse the order of his exclusion.

Sandoval also said they receive regular updates on the status of Boehringer, who was unable to board a flight out of the country for medical reasons.
In an exclusion case, the assessment of a passenger’s fitness to travel rests on the medical staff of the concerned airline.
Sandoval said the bureau is well aware of the situation and extended all possible assistance to the passenger, including medical attention from his chosen physician.
She added that Boehringer will board his flight to Guangzhou once he is declared fit to travel.
