The Supreme Court’s (SC) aggressive, rapid handling of recent high-profile political petitions has left many observers with the distinct impression that the judiciary is adopting a “make my day” stance to cut through political standoffs.
By acting with unusual speed, the High Court is signaling its refusal to let its processes be used to drag out political gamesmanship.
The Supreme Court rejects impeachment stalling tactics
The most striking example of this decisive posture is the Supreme Court’s unanimous 14-0-1 decision dismissing petitions that sought to halt or alter the rules of the ongoing impeachment proceedings.
1. The Standoff: Multiple petitions had sought a status quo ante order to freeze the trial, questioning the Senate impeachment court’s ruling on voting thresholds and its authority to convene.
2. The High Court’s Response: The Supreme Court dismissed the filings outright due to “lack of standing and prematurely.” It firmly reminded the public that the Senate has sole constitutional authority over the impeachment trial and the judiciary will not issue mandamus orders to micromanage a co-equal branch of government.
