Noise complaint

Joji Alonso

Dear Atty. Peachy,

This holiday season, I find myself in a bit of a pickle with my neighbors. They have been throwing loud parties with a booming sound system, and it feels like the festivities have taken over our quiet corner of the neighborhood. The noise has not only disrupted my family’s ability to enjoy our own holiday celebrations, but it has also affected other neighbors, who seem equally frustrated.

I appreciate that this time of year is all about celebration and cheer, but the volume of their parties has escalated to the point where it becomes challenging to relax at home. Despite my attempts to address the matter politely with them, it has not seemed to make any difference.

What steps can I take to address this situation legally? Are there specific laws that protect us from excessive noise from our neighbors? How should I navigate this situation with my neighbors or local authorities to find a resolution?

Thanks in advance for your help.

Elise

Dear Elise,

Start by checking your local government unit (LGU) for existing noise ordinances. These regulations typically set permissible noise levels and designate quiet hours, which are often from 10 p.m. to 6 a.m. By understanding these rules, you can better frame your concerns and determine if your neighbors are violating any laws.

Maintain a detailed log of each noise disturbance. Record the dates, times, and descriptions of the noise (e.g., loud music, shouting). Note the duration and frequency of these disturbances, especially how they interfere with your family’s ability to celebrate the holidays. This documentation will be crucial if you need to escalate the situation later.

If you have not done so already, consider approaching your neighbors once more. Politely express your concerns about the noise level and how it affects your family’s holiday experience. While you mentioned that you’ve tried speaking to them before, sometimes reiterating the issue, especially during a festive time when people may be more understanding, can lead to a positive outcome.

If direct communication does not yield results, it may be time to file a formal complaint with the Katarungang Pambarangay. This process initiates mediation and dispute resolution within your community. When filing your complaint, be prepared to present your documentation to support your claims. The barangay officials can help facilitate a discussion between you and your neighbors to find a mutually agreeable solution.

Wishing you and your family a peaceful and joyful holiday season! If you need further assistance or have more questions, please feel free to reach out.
