Teodoro to sue Marikina Comelec officer over delayed proclamation

Congressman-elect Marcelino “Marcy” Teodoro on Tuesday said he will file charges against the election officer and other officials of the Commission on Elections (Comelec) in Marikina for failing to proclaim him despite the Comelec en banc issuing a certificate of finality reinstating his candidacy.

“It's contempt, because the Comelec en banc already issued a final and executory order directing the board of canvassers to convene and proclaim the winning candidate from the 12 May elections,” Teodoro said in a press briefing.

Teodoro also said they will file administrative charges against Marikina Comelec election officer Atty. Dave Villarosa at the Comelec central office for defying the directive.

“There may also be violations of dereliction of duty, graft, and grave abuse of discretion — where my rights as a candidate are being disregarded due to this unnecessary delay in proclamation,” he said.

“This is not just about an individual’s rights — it’s also about the rights of the voters. A new term has already started, and yet no one has been proclaimed,” he added.

Teodoro has filed an urgent request for his immediate proclamation as the duly elected congressman of the city's 1st District.

The Comelec en banc has declared final and executory its ruling reinstating Teodoro’s certificate of candidacy for Marikina City’s 1st District congressional race.

The en banc reversed an earlier decision by the Comelec First Division and granted Teodoro’s consolidated motions for reconsideration, thereby denying the petitions filed by Aquilino “Koko” Pimentel III, Katrina Mari Faye Marco, Angelu Estanislao, and Ma. Luisa de Guzman to cancel his certificate of candidacy.

The en banc also lifted the prior suspension of Teodoro’s candidacy and confirmed that no temporary restraining order was issued by the Supreme Court within five days of the ruling—making the decision immediately enforceable.

Teodoro won the 12 May congressional election with 75,062 votes, defeating former senator Pimentel.
