Winning Manila Sixth District Representative Joey Chua Uy filed a petition Monday with the Supreme Court (SC) seeking to immediately prevent the Commission on Elections (Comelec) from nullifying his victory in the May 2025 midterm elections.
The Comelec’s decision stemmed from questions about his natural-born Filipino citizenship.
In a 75-page petition for certiorari and prohibition, Uy, through his counsel Gialogo & Associates led by lawyer Edward Gialogo, urged the court to nullify the Comelec’s Second Division resolution dated 18 June 2025 and the Comelec en banc resolution dated 30 June 2025.
These resolutions annulled his proclamation and declared his rival, Bienvenido “Benny” Abante Jr., as the duly elected member of the House.
The lawmaker also asked the court to issue a temporary restraining order to immediately enjoin Comelec from implementing the challenged resolutions. Following a summary hearing, the petitioner requested a writ of preliminary injunction or a status quo ante order to allow him to assume his post pending the resolution of his petition on its merits.
Uy maintained that he formally assumed his post on 30 June 2025, after being proclaimed the winner.
