Senator Ronald “Bato” dela Rosa has asked the Supreme Court to issue a temporary restraining order (TRO) to stop the government from serving a supposed arrest warrant issued against him by the International Criminal Court (ICC).
In an urgent manifestation, Dela Rosa sought to bar the government from enforcing or facilitating any ICC warrant or surrender request, assisting ICC witnesses through government programs, or transmitting ICC communications through diplomatic or law enforcement channels.
He also asked the High Court to order the Department of Justice (DoJ) and Department of Foreign Affairs (DFA) to disclose within 72 hours if an ICC-related communication or warrant had been received or processed.
The petition stemmed from a case he and former President Rodrigo Duterte filed in March, after Duterte’s arrest and transfer to The Hague, seeking to block the government from cooperating with the ICC.
Ombudsman Jesus Crispin Remulla earlier said he had an unofficial copy of an arrest warrant, though neither the ICC nor DoJ has confirmed this.
DoJ officials earlier stressed that should a warrant be issued, the Philippine government is obligated to enforce it.
Dela Rosa was Philippine National Police chief during Duterte’s drug war, which the ICC is investigating.
