Suspension order lodged against Palawan vice mayor

As of 3 November 2003, SSGMAI no longer exists as a corporation because its license from the Securities and Exchange Commission was revoked by SEC on 3 November 2003.

Suspended Narra Mayor Grandy Danao has lodged a motion for a 90-day preventive suspension against Vice Mayor Crispin Lumba and five members of the Sangguniang Bayan the other before the Palawan Provincial Board for dereliction of duty, grave misconduct, and conduct prejudicial to the best interest of service by allowing to operate a fraudulent cockpit in the municipality.

“The respondents, at least for 2017, 2018, and 2019, absconded from discharging their clear duty and responsibility under the foregoing statutory provision. For keeping silent and closing their eyes on the irregular situation with respect to cockpit ownership and operations in the municipality, respondent Vice Mayor and other respondents are liable for gross negligence. They are also guilty of grave misconduct,” said Atty. Edwin Gastanes, pro bono counsel of Danao.

Aside from Lumba, others charged under Administrative Case no. 03-43-2020 were Clarito Demaala IV, Janet Nabua, Arnold Verano, Cenon Garcia, and Karen Socrates.

Gastanes said a certain Randy Arimado was granted a permit to operate a cockpit from 2017 to 2019 without a legislative franchise.

He added that while Southern Star Gamefowl Management Assocaiation Inc. (SSGMAI) was granted a franchise to operate a cockpit in 1995, “that franchise lasted only up to 3 November 2003.”

“As of 3 November 2003, SSGMAI no longer exists as a corporation because its license from the Securities and Exchange Commission (SEC) was revoked by SEC on 3 November 2003,” stated Gastanes, adding that because of the SEC revocation, the existence of SSGMAI was legally terminated.

As such. it can no longer legally enter into any legal relations, and it cannot be a beneficiary of any privilege such as a municipal franchise, Gastanes furthered.

He then said that the 2019 Mayor’s Permit for a cockpit business, with number BP 2019-2017-0 was supposedly issued to Arimado on 6 January 2019, and which was on file with the Licensing Unit of the municipality indicating an amount paid of P33,000 under official receipt no. 1033985.

“Official records in the Treasurer’s Office however showed indubitably that Official Reciept No. 1033985 for the amount of P33,000 was issued to Randy Arimado on 25 June 2019. Therefore, the Mayor’s Permit for 2019 was not issued on 6 February 2019 and such Mayor’s Permit for 2019 is a forgery, fraudulent, void, and illegal. It cannot give rise to any legal right,” Gastanes argued.

Palawan Governor Jose Alvarez slapped Danao with a 60-day preventive suspension starting 28 July 2020 pending trial after Lumba had filed an administrative complaint for negligence against the former.

Lumba took his oath as acting mayor of Narra before Alvarez at the Provincial Capitol last Wednesday, 29 July.
