DOE seeks public input on coal rules

The Department of Energy (DOE) is overhauling the Small-Scale Coal Mining (SSCM) program and is asking the public for input to make mining more transparent, accountable, and environmentally responsible.

Through the Energy Resource Development Bureau and its Coal and Nuclear Minerals Division, the DOE held a consultation on a draft Department Circular that would update SSCM regulations to protect Indigenous Peoples’ rights while promoting responsible resource development.

Key topics discussed included Indigenous Peoples’ protections, tighter environmental safeguards, simplified permitting, and clearer rules on permittee responsibilities, including grounds for permit cancellation.

Participants were briefed on critical requirements, including proper material handling, emission and dust control, emergency preparedness, spill and fire prevention, and documentation obligations such as Compliance Checklists and sworn certifications.

“This first draft marks a new beginning for SSCM. After nearly four decades since 1987, it is time to modernize the program,” Energy Undersecretary Alessandro O. Sales said on Monday.

The consultation coincided with an Information, Education, and Communication campaign on Department Circular No. DC2025-09-0016, which sets rules on coal handling, transport, storage, and distribution.

The Circular boosts health and safety standards, labor protections, environmental safeguards, and operational accountability.
