The Department of Trade and Industry (DTI) has cautioned the public about the widespread sale of counterfeit “Black Ultra” vapor products, warning that the unregulated items pose serious health and safety risks.
In a statement, the DTI’s Office for Special Mandate on Vaporized Nicotine, Non-Nicotine Products, Their Devices, and Novel Tobacco Products (DTI OSMV) said the products are “not authorized, tested or certified and have no connection to any legitimate manufacturer.”
Reports reaching the agency indicated that some distributors and retailers were misled into believing that the items were part of the official X-Ultra product line from X-Vape Technology Inc.
According to the DTI OSMV, the sale and circulation of the counterfeit products “mislead consumers; pose serious health and safety risks due to unknown and unregulated ingredients; distort fair market competition; and harm the reputation of legitimate vape brands.”
The department advised the public not to purchase or use “Black Ultra” products, stressing that they are illegal and not Philippine Standard (PS) License-certified. Retailers and distributors were also reminded to verify products with the DTI before sale and to comply with Republic Act No. 11900, or the Vaporized Nicotine and Non-Nicotine Products Regulation Act, as well as related Department Administrative Orders.
The DTI OSMV said violations may be reported through its official emails, OSMV@dti.gov.ph and OSMV_Comms@dti.gov.ph.
Consumers with complaints involving vape products may also file their concerns through the DTI Consumer Care System at ConsumerCare.dti.gov.ph.
