The Commission on Elections (Comelec) En Banc has issued a resolution declaring finality and immediate executory effect on its decision reinstating the candidacy of Marcelino "Marcy" Teodoro as a member of the House of Representatives for Marikina City’s 1st District.
The ruling reverses a previous decision by the Commission's First Division and grants the consolidated motions for reconsideration filed by Teodoro, thereby denying the petitions to cancel his Certificate of Candidacy (COC) filed by Aquilino “Koko” Pimentel III, Katrina Mari Faye Marco, Angelu Estanislao, and Ma. Luisa de Guzman.
“Wherefore, premises considered, the Commission (En Banc) grants the Consolidated Motions for Reconsideration. The Resolution dated 11 December 2024 promulgated by the Commission (First Division) is hereby reversed and set aside," stated the Comelec En Banc in its Certificate of Finality and Entry of Judgment dated 1 July.
The En Banc ruling lifts the previous order suspending Teodoro’s COC.
“The Order for the suspension of the proclamation of respondent Marcelino 'Marcy' R. Teodoro issued by the Commission (En Banc) on 12 May 2025 is hereby lifted. Finally, the Certificate of Candidacy of herein respondent Marcelino 'Marcy' R. Teodoro for Member of the House of Representatives, 1st District, Marikina City in the 12 May 2025 National and Local Elections is hereby reinstated,” the resolution reads.
Comelec further confirmed that the resolution is now final and executory, as no restraining order was issued by the Supreme Court within the five-day period following promulgation.
“Now therefore, in view of the foregoing, the Resolution of the Commission (En Banc) promulgated on 25 June 2025 is hereby declared immediately executory under the Comelec Rules of Procedure, and Comelec Resolution No. 11046.”
Earlier, the poll body lifted the suspension of Teodoro’s proclamation as the winning congressional candidate for Marikina City’s 1st District.
In a 38-page resolution promulgated on 25 June, the Comelec En Banc granted Teodoro’s motions for reconsideration and overturned the First Division’s 11 December 2024 ruling that canceled his candidacy. The En Banc ruled that petitioners failed to prove that Teodoro committed material misrepresentation regarding his residency in Barangay San Roque, 1st District.
In an ambush interview, Comelec Chairperson George Garcia said the resolution also directs the City Board of Canvassers of Marikina to immediately proclaim Teodoro.
"Therefore, when the City Board of Canvassers of Marikina convenes, they will implement the disposition contained in the Comelec decision which has become executory because five days have passed," Garcia told reporters.
"When it will be proclaimed, we cannot interfere with them, because there are rules of procedure that the City Board of Canvassers follows when they will convene after what is called a notice to the party," he added.
Teodoro topped the 12 May congressional election in Marikina City’s 1st District with 75,062 votes, defeating Pimentel.
