The Department of Trade and Industry (DTI) Office for the Special Mandate on Vaporized Nicotine and Non‑Nicotine Products, their Devices, and Novel Tobacco Products (OSMV) reminds the public that the distribution of SHFT products—whether for sale or for free—is strictly prohibited, in line with the issued Preliminary Order (PO) and Preventive Measure Orders (PMOs) against SHFT, its manufacturer and importer.
In a statement on Monday, the OSMV said the reminder follows SHFT’s 16 April 2025 social‑media post indicating its intent to give away products “for free while supplies last.”
“The public is strongly advised that any sale or distribution of SHFT products, including free giveaways, remain in violation of the standing PMOs,” the OSMV said.
PMOs were issued against SHFT on 6 September 2024 and 31 January 2025 for violations of Sections 4(d) and 18 of RA 11900 (Vaporized Nicotine and Non‑Nicotine Products Regulation Act) and Department Administrative Order 02‑2007 in relation to Philippine National Standards pursuant to RA 4109 (Standards Law) and RA 11900.
Pending resolution of formal charges, the DTI OSMV reiterates that the conditions in the Certificate of Conditional Release (CCR) remain in full effect.
“These conditions clearly state that the transfer, use, sale, and/or distribution of the shipment, in whole or in part, is strictly prohibited,” the agency said.
“The DTI OSMV urges the public to refrain from engaging in any activity involving SHFT products, and warns that any violation of the PMOs or CCR will result in penalties,” it added.
