DoLE issues holiday pay guidelines

The Department of Labor and Employment (DoLE) on Tuesday released the guidelines for compensating workers who will work on 1 November (All Saints’ Day) and 2 November (All Souls’ Day).

In a statement, the DoLE said that both days have been declared as special non-working days and based on Labor Advisory 15, series of 2018, the rules are as follows — for work done on these days, an employee will receive an additional 30 percent in his/her basic wage on the first eight hours.

It also added that for overtime, the employee will be paid an additional 30 percent on his/her hourly rate.

The appropriate determination of holiday pay according to the prescription of the Labor department added that for work done during these days that fall on the employee’s day off, he/she will receive an additional 50 percent in his/her basic wage on the first eight hours.

The Labor agency also noted that the “now work, no pay” policy shall apply “unless there is a favorable company policy, practice or collective bargaining agreement granting payment on a special day.”
