Court denies Trillanes motion

Judge Elmo Alameda of the Makati Regional Trial Court Branch 150 yesterday denied Sen. Antonio Trillanes IV’s motion for reconsideration over his arrest after the revocation of his amnesty by President Rodrigo Duterte.

In his five-page order, Alameda stated that there is nothing in the certification by Lt. Colonel Thea Joan Andrade that can prove his application got amnesty — a requirement before he could be granted with one.

The court also ruled that Trillanes failed to submit new arguments to support his motion and added the senator committed a serious error in claiming that the ruling of the court was not based on evidence.

“Even if the hearing has been characterized as mere summary in nature, it does not mean that this court did not evaluate and carefully weighed the evidence by the parties. As to the failure of Trillanes to admit his guilt of crimes of rebellion and coup d etat, this was sufficiently established through the certified true copy of an online report written on 5 January 2011. Such report is in conflict and irreconcilable with Sen. Trillanes pronouncement that he applied for amnesty and admitted his guilt,” Alameda said.
