BoC issues detention on P20-M red onions

Laborers transporting the smuggled red onions failed to show any documents that legalized the transport of the commodity

ZAMBOANGA CITY — The Bureau of Customs Port of Zamboanga issued on Wednesday a warrant of seizure detention on the estimated P20 million worth of red onions seized by authorities here on Sunday and Monday this week.

BoC Zamboanga City district collector Segundo Barte Jr. revealed that the issuance of the WSD was based on the recommendation of the Department of Agriculture-Bureau of Plant Industry here.

He explained that the agency has requested for a WSD issuance for the red onions intercepted by authorities here as laborers transporting the smuggled red onions failed to show any documents that legalized the transport of the commodity.

“I have no choice. I have to seize it because of the failure of the personnel to present documents to transport the red onions legally,” Barte said. “The importation of red onion needs a permit from DA-BPI Zamboanga City and since it has no permit to import, it became now a smuggled agricultural product.”

Barte added that the onions might be contaminated with some disease as they have no Sanitary and Phytosanitary Import Clearances and appropriate importation documents.

The BoC official reminded traders that they should get clearance from DA-BPI Zamboanga City before importing agricultural products from other countries.

The smuggling of agricultural products is violative of the Anti-Agricultural Smuggling Act of 2016 (RA 10845), the Intellectual Property Code of the Philippines (RA 9283), and the Customs Modernization and Tariff Act (RA 10863).

The red onions are subject to seizure and forfeiture proceedings for violation of Section 1400 of RA 10863 or the Customs Modernization and Tariff Act, concerning Section 3 of RA 10845 or the Anti-Agricultural Smuggling Act of 2016.
